Headquartered in the National Capital Region, Canada, the Canadian Transportation Agency administers and applies certain federal transportation legislation as an independent, quasi-judicial decision-maker and regulator on air, federal rail and marine, and, in the case of accessibility, extra-provincial bus matters. The Canadian Transportation Agency has three broad mandates:

  • Helping to ensure that the national transportation system runs efficiently and smoothly in the interests of all Canadians: those who work and invest in it; the producers, shippers, travelers and businesses who rely on it; and the communities where it operates;

  • Protecting the human rights of persons with disabilities to an accessible transportation network; and

  • Providing consumer protection for air passengers.

To help advance these mandates, the Canadian Transportation Agency uses three tools:

  • Rule-making: The Canadian Transportation Agency develops and applies ground rules that establish the rights and responsibilities of transportation service providers and users and that level the playing field among competitors. These rules can take the form of binding regulations or less formal guidelines.

  • Dispute resolution: The Canadian Transportation Agency resolves disputes that arise between transportation providers on the one hand, and their clients and neighbours on the other, using a range of tools from facilitation and mediation to arbitration and adjudication.

  • Information provision: The Canadian Transportation Agency provides information on the transportation system, the rights and responsibilities of transportation providers and users, and the Canadian Transportation Agency's legislation and services.

As independent decision-makers, Members of the Canadian Transportation Agency are assigned to Panels by the Chairperson to make decisions, orders and determinations related to disputes and regulatory applications. Although most formal dispute adjudications and regulatory determinations are processed through written hearings, oral hearings may be held. Members of the Agency may also be appointed to act as arbitrators or mediators in a wide variety of transportation-related disputes.

Successful candidates may be appointed to a roster established by the Governor in Council, from which the Minister of Transport appoints Temporary Members of the Canadian Transportation Agency, based on requests from the Agency's Chairperson. Temporary Members are paid on a per diem basis for their work on files assigned to them by the Chairperson.

Education and Experience

  • A degree from a recognized university in a relevant field of study, or an acceptable combination of relevant education, job-related training and/or experience;

  • Significant* experience in assessing complex and sensitive information in the view of making decisions and recommendations at a senior level in public or private sector organizations;

  • Experience in the interpretation and application of laws, regulations, guidelines and procedures would be considered an asset;

  • Experience in one of the transportation sectors (air, rail or marine) would be considered an asset;

  • Experience working with the protection of human rights or rights of persons with disabilities would be considered an asset; and

  • Experience working in administrative law or with a quasi-judicial tribunal would be considered an asset.

*Significant experience must have been acquired for a period of approximately five (5) years at a senior level.

Knowledge, Skills and Abilities

  • Knowledge of the mandate, mission and activities of the Canadian Transportation Agency, as well as the legislative framework within which it operates;

  • Knowledge of current trends, issues, and developments of the transportation sector in Canada;

  • Knowledge of adjudicative practices and processes, arbitration practices and processes, as well as the principles of administrative law and natural justice;

  • Excellent communication skills both in written and oral;

  • Ability to interpret and apply the provisions of relevant statutes, regulations, policies, and other guidelines in a decision-making environment;

  • Ability to analyze and synthesize differing opinions and complex technical information; and

  • Ability to render fair, equitable, and timely decisions.

Language Requirements

Proficiency in both official languages would be preferred.

Eligibility Factors and Conditions of Employment

  • Appointees must comply with the Ethical and Political Activity Guidelines for Public Office Holders throughout their appointment as a term and condition of employment. The guidelines are available on the Governor in Council Appointments website under the Forms and reference material.

  • All appointees are subject to the Conflicts of Interest Act. Public office holders appointed on a full-time basis must also submit to the Office of the Conflict of Interest and Ethics within 60 days of appointment, a confidential report in which they disclose all of their assets, liabilities and outside activities.   • Appointees must uphold the highest standards of probity and are expected to demonstrate behaviours in the workplace that afford respect, equality and dignity, to everyone they interact with at work at all times. The Values and Ethics Code for the Public Sector outlines the values and expected behaviours for public servants, including valuing diversity and creating workplaces free from harassment and discrimination. Governor in Council appointees are expected to uphold and respect these values and principles in a positive and active manner.

  • A member appointed shall not, directly or indirectly, as owner, shareholder, director, officer, partner or otherwise, be engaged in a transportation undertaking or business; or have an interest in a transportation undertaking or business or an interest in the manufacture or distribution of transportation plant or equipment, unless the distribution is merely incidental to the general merchandising of goods (statutory).

  • A member shall be a Canadian citizen or a permanent resident within the meaning of subsection 2 (1) of the Immigration and Refugee Protection Act (statutory), at the time of appointment.

  • As per subsection 18 (2) of the Canadian Transportation Act, the members appointed under subsection 7 (2) shall reside in the National Capital Region described in the schedule to the National Capital Act or within any distance of it that the Governor in Council determines (statutory).

  • If you are appointed to this position, you must be willing to travel across Canada and internationally.
